1. Acceptance of Terms
These Terms and Conditions (“Terms”) govern your access to and use of the Snackery: Variant Discounts Shopify application (“App”) and the snackerylabs.com website (“Website”), operated by Wuforia LLC dba Snackery Labs (“Snackery Labs,” “we,” “us,” or “our”). By installing the App or using our Website, you agree to these Terms in full. If you do not agree, do not use our services.
2. Description of Service
The App is a Shopify application that enables merchants to create rule-based variant-level discounts on their Shopify stores. Features include multi-field filtering, AND/OR logic, campaign scheduling, automatic discount syncing, and metafield filtering. The App integrates with and operates within the Shopify platform. Snackery Labs is not affiliated with or endorsed by Shopify Inc.
3. Eligibility of Account & Requirements
To use the App you must:
– Have a valid Shopify store account in good standing
– Be at least 18 years of age or the age of majority in your jurisdiction
– Have the legal authority to enter into binding agreements on behalf of your business
– Comply with all applicable Shopify Partner and App Store terms
4. Subscription, Billing, and Free Trial
The App is offered under the following plans:
– Snack Pack (Starter): $4.00/month
– Feast Mode: $12.00/month
A free trial is available upon installation. Billing is handled entirely by Shopify through the Shopify Billing API. By activating a paid plan, you authorize Shopify to charge your account on a recurring monthly basis. Subscription fees are non-refundable except where required by applicable law. Snackery Labs reserves the right to modify pricing with reasonable advance notice.
5. Acceptable Use
You agree not to:
– Use the App in any way that violates Shopify’s Terms of Service or Acceptable Use Policy
– Attempt to reverse engineer, decompile, or extract source code from the App
– Use the App for fraudulent, deceptive, or unlawful purposes
– Interfere with or disrupt the App’s infrastructure or servers
– Resell or sublicense access to the App without written authorization from Snackery Labs
6. Intellectual Property
All content, code, design, trademarks, and materials associated with Snackery: Variant Discounts and the Snackery Labs brand are the exclusive property of Wuforia LLC dba Snackery Labs. Nothing in these Terms transfers any intellectual property rights to you. You are granted a limited, non-exclusive, non-transferable license to use the App solely for your own Shopify store operations during the term of your subscription.
7. Third-Party Services
The App operates on the Shopify platform and may interact with third-party services including Google Analytics for usage analytics. Your use of Shopify is governed by Shopify’s own Terms of Service and Privacy Policy. Snackery Labs is not responsible for the availability, accuracy, or policies of any third-party services.
8. Disclaimer of Warranties
THE APP AND WEBSITE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. SNACKERY LABS DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF BUGS OR VIRUSES. WE DO NOT WARRANT THAT THE APP WILL PRODUCE ANY PARTICULAR COMMERCIAL OUTCOME FOR YOUR STORE. YOUR USE OF THE APP IS AT YOUR SOLE RISK.
9. Limitation of Liabilities
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WUFORIA LLC DBA SNACKERY LABS AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify, defend, and hold harmless Wuforia LLC dba Snackery Labs, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the App, your violation of these Terms, or your violation of any rights of a third party.
11. Termination
Snackery Labs reserves the right to suspend or terminate your access to the App at any time for violation of these Terms or for any other reason at our discretion with reasonable notice. Upon termination, your license to use the App immediately ceases. You may cancel your subscription at any time through your Shopify admin; cancellation takes effect at the end of the current billing period.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Union County, New Jersey.
13. Changes to These Terms
We reserve the right to update these Terms at any time. When we make material changes, we will update the “Last Updated” date above and, where feasible, provide notice through the App or via email. Continued use of the App after changes take effect constitutes your acceptance of the revised Terms.
